Any person may report sex discrimination, including sexual harassment, in person, by mail, by telephone or by email using the contact information above. Reports may be made at any time, including outside regular business hours. The person reporting does not have to be the person who experienced the alleged conduct.

Inquiries about Title IX may be referred to a Tiffin City Schools Title IX Coordinator, the U.S. Department of Education’s Office for Civil Rights or both.

Retaliation against any person for reporting sex discrimination, participating in a Title IX process or exercising rights protected by Title IX is prohibited.

What Happens After a Title IX Report?

Tiffin City Schools responds promptly and equitably to reports of sex discrimination and sex-based harassment. Making a report does not automatically begin a formal investigation. The Title IX Coordinator will contact the affected person or their parent/guardian to discuss immediate safety concerns, available supportive measures and options for proceeding.

Supportive Measures

Supportive measures may be offered before or after a formal complaint is filed. These are individualized, non-disciplinary and non-punitive services intended to restore or preserve access to the District’s educational programs and activities. Examples may include counseling referrals, schedule changes, safety planning, academic adjustments or restrictions on contact.

Initial Assessment

The Title IX Coordinator conducts an initial assessment to determine:

• Whether the reported conduct may fall within Title IX

• Whether immediate safety measures are needed

• Whether the District has authority over the individuals and conduct involved

• Whether another District policy or process may also apply

• Whether informal resolution or a formal grievance process may be appropriate

A report that does not meet the requirements for a formal Title IX investigation may still be addressed under another District policy or student or employee conduct process.

Formal Complaint and Written Notice

The formal grievance process begins when a complainant files a signed formal complaint or when the Title IX Coordinator initiates one as permitted by law.

If the District proceeds with a formal investigation, the known parties will receive a written Notice of Investigation and Allegations, sometimes called a NOIA. The notice will include the allegations, the identities of the parties and the date and location of the alleged conduct when known. It will also explain the applicable grievance process, state that the respondent is presumed not responsible unless a determination is made and explain each party’s right to an advisor.

The notice may be supplemented if additional allegations are added during the investigation.

Investigation and Evidence Review

A trained and impartial investigator will gather relevant information. Both parties will have an equal opportunity to:

• Provide statements and identify witnesses

• Submit relevant evidence

• Attend meetings with an advisor of their choice

• Receive advance written notice of investigative meetings

• Review evidence directly related to the allegations

• Review and respond to the investigative report

The burden of gathering evidence and reaching a determination rests with the District, not with either party.

Determination and Appeal

After the investigation, a trained decision-maker who did not serve as the investigator will issue a written determination. The determination will explain the findings, conclusions and rationale and will identify any applicable remedies or disciplinary sanctions.

Both parties will receive the determination simultaneously and will be provided information about their appeal rights. An appeal will be decided by a trained individual who did not previously serve as the Title IX Coordinator, investigator or decision-maker in the matter.

Informal Resolution

When permitted by law, the District may offer a voluntary informal resolution process. Both parties must provide written consent and either party may withdraw before an agreement is reached. Informal resolution will not be used to resolve an allegation that an employee sexually harassed a student.

Privacy and Retaliation

The District will protect the privacy of the parties and witnesses to the extent permitted by law. Retaliation against anyone who reports discrimination, participates in a Title IX process or declines to participate is prohibited.

Policy Transition Notice

Tiffin City Schools is transitioning its policy service from OSBA to NEOLA. Existing Board policies remain in effect unless and until they are formally amended or replaced by Board action. The District’s Title IX policy and administrative procedures are currently being reviewed.

This page provides a general overview and does not replace controlling federal or state law or an applicable Board policy. The Title IX Coordinator will provide the applicable grievance procedure, supportive-measure information and next steps to the parties involved in any report or complaint.
